Welcome to Peculiar Shara Art (“Peculiar Shara Art,” “we,” “us,” or “our”).

These Terms and Conditions govern the access and use of our website, as well as purchases, commissions, experiences, workshops, exhibitions, collaborations, and other services or activities offered under the Peculiar Shara Art brand.

By browsing this site, making a purchase, contracting a service, or participating in any of our experiences, you accept these Terms and Conditions.

Peculiar Shara Art is an artistic project dedicated to the creation and commercialization of original artwork, artistic editions, reproductions (MIRRORS AND ECHOES), objects derived from the artwork (ARTIFACTS), commissioned projects, and experiences related to art and creativity.

2. Eligibility

To make a purchase through our site, you must:

• Have the legal capacity to enter into contracts in accordance with applicable law.
• Have a valid payment method accepted by our platform.
• Be authorized to use said payment method.
• Provide true, complete, and updated information during the purchase process.

In the case of minors, purchases must be made with the authorization and supervision of their mother, father, or legal guardian.

3. Privacy and Data Protection

Personal information provided to Peculiar Shara Art will be used solely to manage purchases, shipments, communications, experiences, customer service, and other activities related to our brand, in accordance with our Privacy Notice.

By providing your personal data, you declare that the information is correct and authorize its processing in accordance with said Privacy Notice.

4. Artworks, Products, Prices, and Availability

All artworks and products are subject to availability.

In the case of original artworks, each piece is unique. Once acquired and payment confirmed, it will no longer be available to other buyers.

Editions, reproductions, and other products may be subject to limited quantities or specific periods of availability.

We make our best effort to faithfully represent each artwork and product through photographs, descriptions, and specifications. However, colors may vary slightly depending on the screen, device, lighting, or settings used to view the site.

Likewise, due to the artistic and handcrafted nature of some products, there may be small variations between pieces. These characteristics are part of their creation process and do not necessarily constitute a defect.

All prices are shown in the currency indicated on the site and include applicable taxes where appropriate.

Peculiar Shara Art reserves the right to modify prices, availability, features, or promotions at any time. Changes will not affect purchases that have already been confirmed.

In case of an obvious error in the price or information of a product, we will contact you before processing the order to offer you the option to continue with the purchase under the correct conditions or receive the corresponding refund.

5. Payments and Advance Payments

Payment must be made using one of the methods available on our site at the time of purchase.

By confirming a purchase, you authorize the corresponding charge for the total amount indicated during the payment process.

For certain original artworks, commissions, personalized projects, collaborations, or experiences, Peculiar Shara Art may request an advance payment.

The specific conditions for the advance payment, payment schedule, delivery, and cancellation will be communicated before confirming the project.

For commissioned artworks or personalized projects, creative work may only begin after receiving the agreed advance payment.

6. Purchase Confirmation

After making a purchase, you will receive a confirmation via the email address provided.

Receipt of this confirmation indicates that we have received your purchase request.

Peculiar Shara Art may cancel a transaction in exceptional circumstances, for example, when there is an inventory error, pricing error, payment error, artwork availability issue, or insufficient information to complete the order.

If a payment has already been made and the purchase must be canceled due to reasons attributable to Peculiar Shara Art, a corresponding refund will be issued.

7. Shipping and Deliveries

Orders will be shipped through courier providers selected according to the destination, dimensions, and characteristics of each piece.

Estimated costs and delivery times may vary depending on the product and destination.

In the case of original artworks or special pieces, specific packaging, insurance, and transport conditions may apply.

We will make our best effort to ensure that each piece arrives in suitable conditions. However, delays may occur due to circumstances beyond our control, including situations related to courier companies, customs, weather conditions, or force majeure events.

For international shipments, the buyer will be responsible for taxes, tariffs, customs duties, or other applicable charges in the destination country, unless expressly stated otherwise during the purchase.

8. Intellectual Property and Copyright

All artworks, illustrations, photographs, texts, poems, designs, images, collection names, graphic materials, products, digital content, and other creative elements presented on this site are the property of Peculiar Shara Art and/or its artist Shara Ivette Chávez, unless expressly stated otherwise.

The purchase of an original artwork, edition, reproduction, or Artifact implies the acquisition of the corresponding physical object, but does not transfer the copyright or reproduction rights of the artwork.

No artwork or content may be reproduced, copied, modified, distributed, commercialized, digitized, used to create products, employed for advertising purposes, or commercially exploited without prior written authorization.

Images of the artworks may be shared for personal and non-commercial purposes, provided that authorship is clearly acknowledged and they are not altered.

All rights not expressly granted remain reserved.

9. Commissioned Artworks

Commissioned artworks or personalized projects will be subject to particular conditions agreed upon before commencing the work.

These conditions may include:

• Concept and scope of the project.
• Dimensions and materials.
• Price.
• Required advance payment.
• Estimated completion time.
• Number of revisions, when applicable.
• Delivery conditions.

Due to the personalized nature of these artworks, once the creative process has begun, there may be restrictions on cancellation or return.

Contracting a commissioned artwork also does not imply the transfer of copyright, unless there is a written agreement expressly stating otherwise.

10. Exhibitions, Workshops, and Experiences

Peculiar Shara Art may organize exhibitions, workshops, gatherings, creative experiences, and collaborations.

Access conditions, price, cancellation, and refund policies may vary for each event and will be communicated at the time of registration or purchase.

During some activities, photographs or recordings may be taken for documentation and communication purposes of Peculiar Shara Art. When applicable, participants will be informed about such recordings and the intended use of the material.

11. Returns, Exchanges, and Damages

Our goal is for you to receive your artwork or product in excellent condition.

Due to the nature of original artworks, limited editions, personalized pieces, and certain artistic products, return conditions may vary depending on the type of product purchased.

Commissioned or personalized artworks cannot be returned due to a change of mind once the creative process has begun, unless there is a prior written agreement or any legal provision applicable that states otherwise.

If an artwork or product arrives damaged, incorrect, or has a defect, please contact us within 7 calendar days of receipt, including photographs of the product and packaging so that we can review the case.

Depending on the circumstances, we may offer repair, replacement, exchange, or refund, as appropriate and in accordance with applicable law.

12. Third-Party Providers and Services

Our site may use services provided by third parties for payment processing, e-commerce, messaging, communications, or other functions necessary to operate the store.

The use of such services may also be subject to the terms, conditions, and privacy policies of each provider.

Peculiar Shara Art will not be responsible for interruptions, errors, or delays attributable exclusively to such providers and which are beyond our reasonable control.

13. Limitation of Liability

Peculiar Shara Art will make reasonable efforts to keep the information on this site updated and available.

However, we do not guarantee that the site will operate without interruption or that it will be completely free of technical errors.

To the extent permitted by applicable law, Peculiar Shara Art will not be liable for indirect damages arising from circumstances beyond our reasonable control.

Nothing in these Terms and Conditions is intended to limit the rights corresponding to the consumer under applicable Mexican law.

14. Applicable Law

These Terms and Conditions will be governed by and interpreted in accordance with the applicable laws of the United Mexican States.

Any dispute will initially be addressed by seeking a direct and good-faith solution between the parties, without prejudice to the consumer protection rights and mechanisms provided by Mexican law.

15. Modifications

Peculiar Shara Art may update these Terms and Conditions when there are changes in our products, services, operation, or legal requirements.

The current version will be available on this site and will indicate the date of its last update.
